Is CBD Legal?

The legal status of CBD can be confusing for consumers.

Just in the past year, the Orange County Police Department arrested a grandmother at Disneyworld for having CBD in her purse.

Here’s what’s so confusing:

CBD products are legal nationwide, but THC is not. Many CBD products have no THC content, but THC is regulated differently in states where it is legal.

CBD products purchased online or in a state with relaxed cannabis laws often have high THC content. This is what can get you into trouble.

Last year, Congress passed a farm bill that removed hemp from the Controlled Substances Act, effectively legalizing CBD on a federal level.

Hemp has a minuscule amount of THC in it – no more than 3%. This is such a small amount, that your body would process it long before you would feel any intoxicating effects.

Now, the federal law uses hemp as the guideline for how much THC is too much. But beware – that doesn’t prevent states from making their own legal judgments.

So basically, your CBD products with 3% or less THC is legal to have anywhere the US (unless you’re in any of these 10 no-tolerance THC states – and you’ll need a doctor’s note).

Is CBD Safe to Use?

Plenty of people have reservations about how safe it is to use CBD for one simple reason:

It comes from cannabis, a plant that has been mostly illegal in the United States for decades.

But new research is suggesting that not only is medicinal CBD safe, but patients report fewer and milder side effects with CBD than some other prescription drugs.

The World Health Organization determined that CBD in its pure form is safe and should not be scheduled as a controlled substance in 2017.

Even more recently, the FDA approved the DEA’s decision to reclassify CBD from a Schedule I to a Schedule V substance, indicating low potential for abuse.

Can CBD Get You High?

CBD won’t make you feel “high,” unlike its cannabinoid cousin, THC.

CBD doesn’t cause cognitive or motor impairment, so you can take it and still work, drive, and function like normal.

An important caveat – some CBD products are high in THC. In this case, you may feel an intoxicating effect.

It’s good practice to read your CBD product label to check concentration and purity.

Can I Travel with CBD?

It’s safest to travel within the United States with CBD if you know for sure that it contains less than 3% THC. It’s even better if your CBD has 0% THC.
